Stockback Terms & Conditions

This Agreement is effective 12th June, 2023

Introduction

These Terms and Conditions ("Terms") govern your participation in the Stockback™ Program ("Program") offered by Douugh Ltd ("Douugh", "we", "us", or "our"). By participating in the Program, you agree to be bound by these Terms, which may be updated or amended at our sole discretion. 

Please read these Terms carefully before using the Program.

Eligibility

To be eligible for the Program, you must: (a) be at least 18 years of age; (b) be a resident of Australia; (c) have a valid Douugh Spend Jar account and active Douugh issue Mastercard; (d) have a valid Douugh account in good standing; (e) meet all other Douugh eligibility requirements as stated in Douugh Terms of Service, Financial Services Guide and other disclosure documents which can be found here.

Earning Stockback™ Rewards

The Program allows eligible users to earn Stockback™ Rewards ("Rewards") based on their qualifying purchases using their Douugh Mastercard as follows: (a) Earn up to 3% Stockback™ on your first $100 card spend every month; (b) Earn a bonus 4% Stockback™ on the first $100 Spot every month. 

Stockback ™ rewards are only earned on card transactions, therefore transactions included but not limited to BPAY or account transfers do not earn Stockback ™ rewards. 

A Spot is a short term Pay Now Pay Later loan of up to $500. Users are only eligible for Bonus Stockback ™ if a loan is paid back before, or as per the repayment schedule, in full, and with no late or under payments.

Investment of Stockback™ Rewards

Stockback™ Rewards can be automatically invested in one of the available Douugh investment portfolios. You must select a preferred portfolio for investment for StockBack ™ to be redeemed. 

Stockback™ Rewards are redeemed when your Stockback™ Rewards balance reaches AUD$5. 

Investment orders for Stockback™ Rewards are triggered at midnight the first business day following the balance reaching AUD$5. 

Investment Order of Stockback™ Rewards will be executed as per the Douugh platform rules, are fractional and based on Best Bid Offer rules so may take more than 24 hours to execute and show in your Invest Jar.

All investments on the Douugh Platform are made in US Dollars.

Redemption and Expiry of Stockback™ Rewards

Stockback™ Rewards are not redeemable for cash, are non-transferable, and cannot be combined with any other offers or promotions. Rewards will expire if your Douugh account is closed, terminated, or becomes inactive for a period of 12 consecutive months.

Taxes and Duties

You are responsible for any tax liabilities or duties that may arise in connection with your participation in the Program. We recommend that you consult with a tax professional for advice on your individual circumstances.

Termination, Suspension or Extension of the Program

Stockback ™  is a short term promotion available for the first 30 days after the full launch of Douugh Services to the Australian market. Douugh reserves the right to terminate, suspend, or modify the Program, in whole or in part, at any time, without notice, for any reason or no reason, at our sole discretion. If the Program is terminated or suspended, you will have no further rights to accrue or redeem Stockback™ Rewards.

Limitation of Liability

To the extent permitted by law, Douugh and its affiliates, directors, officers, employees, and agents will not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or in connection with your participation in the Program or any services provided in connection therewith, whether based on contract, tort, negligence, strict liability or otherwise.

Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of the remaining provisions. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Douugh's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Governing Law and Jurisdiction

These Terms and your participation in the Program are governed by the laws of Australia, and you agree to submit to the exclusive jurisdiction.

Additional Terms and Disclosures

These Terms are in addition to Douugh's Terms of Service, Privacy Policy, and any other disclosures or agreements you may have entered into with Douugh. By participating in the Program, you acknowledge and agree that your use of Douugh's services and your participation in the Program are subject to the terms, conditions, and policies set forth in these additional agreements and disclosures. In the event of any conflict between these Terms and any other agreement or disclosure, these Terms will control with respect to the Program, and the other agreement or disclosure will control with respect to the relevant service or subject matter.
